These Terms and Conditions govern your access to and use of the ooono® device and ooono® connect iOS and Android application, and any other products and services, collectively referred to as the ”Services”, provided by Autovice A/S. These Terms constitute a fully binding agreement between Autovice A/S, including its affiliates and subsidiaries, and you. Please read these Terms and Conditions carefully, and contact us if you have any questions. By agreeing to the terms and Conditions you automatically accept our Privacy Policy. By using our Services you agree to be bound by these Terms and Conditions.

The Services may only be used by individuals who can form legally binding contracts under applicable law. The Services are not available to children. By becoming a user, you represent and warrant that you have the right, authority and capacity to enter into and abide by these Terms and Conditions

ooono® is a community based handsfree device and application that warns you of speed traps and road hazards by providing drivers with real-time alerts on their driving environment. ooono® comes pre-mapped with the location of thousands of speed traps and important road hazards in more than 50 countries. On top of that ooono® uses its extensive community of millions of users to mark and update the location of speed traps and road hazards. The ooono® connect app gives you the freedom to specify the type of road safety information you want and when. Easily change your settings on the go. Simple, convenient and easy-to-use. Just drive, avoid tickets and stay safe on the road.

You may only use the Services in compliance with these Terms and Conditions, and all applicable laws in the country in which you use the Services. You may use the Services solely for private and personal purposes. You may not use the Services commercially. Using the Services may include downloading software to your phone or other device. You agree that we may automatically update that software, and these Terms and Conditions will apply to any updates. Subject to these Terms and Conditions we grant you a limited, non-exclusive, non-transferable, and revocable access to download, install, and use the Services for your personal, non-commercial use, strictly in accordance with all applicable laws in your country of usage. By accepting these Terms and Conditions you agree and acknowledge that the Services are intended to be used as a driving aid only. Reliance on and the use of the Services is at a user’s own risk. Laws regarding the use of the Services may vary between countries. A user is responsible for complying with all driving laws. Autovice A/S shall not be liable for any violation by the user of any law or regulation, or for any fine, penalty, punishment or notice of intended prosecution issued to a user. Our services may not be used in any way that is not expressly permitted by these Terms.

Our services may not be available in all languages, in your Country, or for use in a particular location. To the extent you choose to use our Services you are solely responsible for compliance with any applicable laws. You shall not exploit the Services in any unauthorized way whatsoever. You further agree not to use the Services in any manner to otherwise infringe or violate any rights of any other party, and that Autovice A/S  is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive, infringing or illegal messages or transmissions that you may receive as a result of using the Services. Autovice A/S reserves the right to change, suspend, remove, disable or impose access restrictions or limits on the Services at any time without notice or liability to you.

With respect to your use of the Services you agree that you will not:

• Copy the Services
• Modify, translate, adapt or otherwise create derivative works or improvements of the application or device
• Reverse engineer, dissassemble, decompile, decode or otherwise attempt to derive or gain access to the source code of the Services or any part thereof
• Remove, delete, alter or obscure any trademarks or any copyright, trademark, patent or other intellectual property or proprietary rights notices
• Rwent, lease, lend, sell, sublicense, assign, distribute, publish, publicly perform or display, transfer or otherwise make available the Services or any features or functionality of the Services to any third party for any reason
• Install or use the Services on any devices which have been rooted, jailbroken, or had the system controls disabled or altered
• Remove, disable, circumvent or otherwise create or implement any workarounds to any copy protection, rights management or security features in or protecting the Services.
• Upload or introduce any virus or malware to the Services
• Violate any applicable law or regulation in connection with your use of the Services
• Harass, abuse, stalk, threathen or defame any person or entity using the Services
• Redistribute or sublicense the Services
• Engage in scraping, data mining, harvesting, screen scraping, data aggregating or indexing
• Use any robot, spider, scraper or other automated means to access the services database for any purpose without the prior written permissino of Autovice A/S

All intellectual property rights in the Services shall be owned by Autovice A/S absolutely and in their entirety. These rights include database rights, copyright, design rights (whether registered or unregistered), trademarks (whether registered or unregistered) and other similar rights wherever existing in the world together with the right to apply for protection of the same. All other trademarks, logos, service marks, company or product names set forth in the Services are the property of their respective owners. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information provided by you to us are non-confidential and shall become the sole property of Autovice A/S. Autovice shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these information for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

You are responsible for your use of the Services and you You agree to indemnify and hold harmless Autovice A/S and its employees, officers, directors, consultants, affiliates, subsidiaries and agents, as well as all third party advertisers of Ads from and against all claims, damages, expenses, losses and liabilities that arise as a result of your violation of these Terms, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (a) your access to, use of, or alleged use of, the Services; (b) your violation of any portion of these terms, any representation, warranty, or agreement referenced in these Terms, or any applicable law or regulation; (c) your violation of any third-party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; (d) any dispute or issue between you and any third party; and (e) all claims arising from or alleging fraud, intentional misconduct, criminal acts, or gross negligence committed by you. To the fullest extent permitted under applicable law, Autovice A/S reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defense of that claim.

Autovice respects your privacy during your use of our Service. We do not collect, share or sell any personal information to any third party. Please read our Privacy Policy pertaining to the Services for further information. It is recommended that you periodically review the Privacy Policy for updates.

We may collect information relating to how often you use the Services or the frequency with which certain features of the Services are used. This information would be collected anonymously, in a way that does not personally identify you. We may use this information to detect broad user trends and to otherwise enhance our products and the Services. The use of location-based services in the application, which may include traffic information and speed camera information, will cause the physical location of your device to be collected in order to provide you with such location-based services. This location data is collected anonymously in a way that does not personally identify you.

Autovice may collect and use technical data, usage statistics, and related information, including but not limited to technical information about your device, use of the Services, that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any). Autovice A/S may use this information, as long as it is in a form that does not personally identify you, to improve and report on its products or to provide services or technologies to you. Autovice may also collect and upload information such as your location, speed and direction, known as floating car data, in order to enhance the quality of the Service. Autovice may share this data or sell this data to third parties. This data is shared and sold anonymously in a form that does not personally identify you. You grant Autovice A/S a perpetual, irrevocable, worldwide license to use, reproduce, distribute, modify, and adapt any anonymous data comments, posts, or media you contribute to the Services.

By using our Services, you consent to receiving certain electronic communications and promotions from us. You agree that any notices, agreements, disclosures, or other communications or promotions that we send to you electronically will satisfy any legal communication requirements, including that those communications be in writing.

The following disclaimers are made on behalf of Autovice A/S, our affiliates, subsidiaries, data providers, service providers, channel partners, suppliers and affiliated companies as well as our of our respective officers, directors, employees, agents, and shareholders.

The Services are provided ”as is”, and you agree to use them at your own risk. We do not guarantee and do not promise any specific results from use of the Services, including the ability to provide or receive Services at any given location or time. We specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.

Autovice and it’s data providers, service providers, channel partners, suppliers and affiliated companies of Autovice A/S, do not warrant that your use of the Services will be accurate, complete, reliable, current, secure, uninterrupted, always available, or error- free, or will meet your requirements, that any defects in the the Services will be corrected, or that the Services are free of viruses or other harmful components. We disclaim liability for, and no warranty is made with respect to, connectivity and availability of the Services. We make no guarantees, representations or warranties of any kind, express or implied, arising by law or otherwise, including but not limited to, content, quality, accuracy, completeness, effectiveness, reliability, merchantability, fitness for a particular purpose, usefulness, use or results to be obtained from the Services will be uninterrupted or error-free. The traffic ansd speed camera information is informational only. You assume all risks of use. Autovice A/S and our suppliers make no representations about traffic and road conditions, route usability, speed or speed camera. The Services are intended to be used only as supplementary driving aids and must not be used for any purpose requiring precise measurement of speed, direction, distance or location.

Autovice A/S and its suppliers disclaim all liability for any loss, injury or damage resulting from use of or inability to use the Services, as a result of weather difficulties, the destruction of transmitters and/or broad casting infrastructures, a natural disaster, and/or a lack of reliability, completeness or accuracy of the traffic and speed camera data. In no event shall Autovice A/S  be liable to you or any other party for any compensatory, indirect, incidental, special, or consequential damages, including, without limitation, indirect, direct, special, punitive, or exemplary damages for loss of business, loss of profits, business interruption, or loss of business information, arising out of the us eof or inability to use the Services.

Services provided by Autovice are community based, and Autovice is not responsible for the conduct of any User of the Services. You are solely responsible for your interactions with and reports to other Users. By using the Services, you agree to accept such risks and agree that Autovice s not responsible for the acts or omissions of users using the Services.

You are responsible for the use of your Services and Autovice expressly disclaims any liability arising from the unauthorized use of the Services.

Opinions, advice, statements, offers, or other information or content concerning Autovice A/S or the services made available through the Services, but not directly by us, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. Under no circumstances will we be responsible for any loss or damage resulting from your reliance on information, reports or other content posted by third parties, whether on Services or otherwise.

Location data provided by the Service is for basic location purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, property or environmental damage. Neither Autovice nor any of its content providers, guarantees the availability, accuracy, completeness, reliability, or timeliness of location data tracked or displayed by the Services. Any of your Information, including geolocational data, you provide, or report using the Services may be accessible to Autovice and other users of the Services.

Autovice advises you to use the Services with a data plan with unlimited or very high data usage limits, and Autovice shall not be responsible or liable for any fees, costs, or overage charges associated with any data plan you use to access and use the Services.

Autovice A/S may terminate or de-activate your access to the Services at any time without notice or liability to you if we have reason to believe that your access to the Services harm or threaten the safety of users using the Services.

We reserve the right to make changes to these Terms and Conditions at any time without any notifications regarding this matter. It Is strongly recommended to check this page often, referring to the date of the last changes. If you object to any of the changes to this policy, you must cease using our Services.
